How To Fight A Traffic Ticket, Or Not

A new thread on this topic is started at least every week on the car forums. An unfortunate driver gets a bunch of tickets from a “power hungry” cop, and doesn’t want to pay for them so he seeks advice on our forums on how to fight the ticket. The usual responses are to head down to talk to the crown to get the charges reduced or better yet, completely dropped.

Justin Bell was pulled over by an RCMP officer after being clocked going 109 km/h in a 60 km/h zone. While most drivers in this case would accept the ticket and slow down, Bell had other ideas. After talking to the officer and realizing he was going to get a ticket, he asked the officer to speak to him in french instead. When the officer informed Bell he could not speak French, Bell ignored this and continued speaking in french. He continued to ignore the officer who was still speaking english the whole time, that is until the officer uttered “You’re under arrest!”.

“For what?” Bell inquired in English.

“Well, let’s put it this way,” the officer responded. “It’s dangerous driving, 109 in a 60 zone.”

Yesterday, a Saskatchewan judge stayed the charges against Bell after deciding that the RCMP officer did not have legitimate reason to place Bell under arrest. Its important to note that when a charge is stayed, the court is not ruling that Bell is innocent, but instead the charges are invalidated. I’m not a legal expert by any means, but I think the RCMP officer can still re-issue a speeding ticket for the original violation under the Highway Traffic Act. However, even if this was a possibility, I doubt it would happen and more than likely Bell has successfully fought a speeding ticket.

I bet it would’ve been a hell of a lot cheaper to just hire someone like pointts to fight the ticket :)

  1. All that is likely to happen under normal circumstances is that you piss the cop off and you don’t get a break.

    If you’re driving like a nutsack, then just accept the fact you got caught and hope for the best. No reason to make a cop’s job that much less enjoyable.

  2. Don’t EVER hire pointts, its a giant scam. He always takes the first and easiest plea bargain, and you can do that yourself in about half an hour. Hell, you can do BETTER in half an hour. Don’t expect him to reduce to no demerits either. Hire a lawyer, the price point is similar.

  3. Go to traffic court building. Make an appointment to see one of the people to discuss your ticket. Plead it down save money and points. Zero cost. Dress well when you go.

  4. I have always accepted tickets and infractions that i see as reasonable and true. Even if i go to the crown to just negotiate payment terms, he lowers my charge and point automatically just for showing willingness and accountability for my actions. I don’t see the point of causing so much trouble to get out of something you did to begin with. Less bullshit could be encountered with the average person if there wasn’t so many arrogant asses out there!

  5. the thing i see as dumb is one night i went to the club got alil tipsy decided to be smart and NOT drive had my cuzin drive he decided to race a car with me passed out in the passenger seat and i got a noise violation ticket for it for one what vehicle dosent scream when put to the floor compare a 08 cummins with 5 inch exhaust to a honda crx with a stock exhaust system with a 2.5 inch tip… yeah that was a stupid ticket and ill b damned if i am paying it for being smart and not driving drunk

  8. Its funny to hear stories like this, but dont be fooled, they are far adn few between. But there are other tools to fight against traffic tickets.

    One common one is Carter of rights because the trail took to long.

  9. Interesting story, one of the best tips is to avoid the speeding ticket in the first place, one thing you can do is try to stay out of the passing lane on multilane highways as thats the lane officers will target, and try to avoid being the front vehicle.

  11. I just got a ticket for exceding the posted limit in a construction zone. There was no construction going on ,the road was perfect. There were no workers present. I think the workers left early for the weekend and they would come back next week to resume construction. The construction company should get a ticket for declaring a construction zone, then not working. The only worker around was a telephone man driving a vehicle about 100 yards away off the road.

  12. got a ticket for “driving at a speed that is greater than reasonable and safe”. Anyone have any clue on how to fight that. I ended up sliding into the back of someone on an icy patch in saskatoon. thank you.

  14. Jeff, give your head a shake, dude! That IS the whole point - who would not love to make a cop’s job less enjoyable?! No-brainer! Pissing a cop off is one of the joys of life.
