Angela Ta Kills 6 Year Old Girl With BMW, Gets Away With It

Angela Ta Leaves Court, Found Not Guilty on All Charges
In January of last year a 6-year-old, Jenna Chang was killed and her mother Ye Qiao was seriously injured while in a crosswalk near the University of Calgary. Even though a vehicle was already stopped in front of the crosswalk, a black BMW driven by Angela Ta failed to stop and hit the two pedestrians. Ta was charged with three traffic violations, careless driving, failing to yield to a pedestrian in a crosswalk and passing a vehicle stopped for a pedestrian in a crosswalk.
On Monday, she was found not guilty on all three charges because of a simple technicality. The Judge in the case, Catherine Skene ruled that Ta did not have enough time to stop:
“Based on the evidence and testimony that I did have before me,” wrote Skene, “there is evidence to suggest that the two pedestrians stepped off the sidewalk and/or curb, onto the roadway — specifically westbound 32nd Avenue into the path of Ta’s vehicle when Ta’s vehicle was so close that it was impracticable for the driver to yield the right of way.”
What a load of bullshit! There was a vehicle already stopped at the crosswalk, and every driver is expected to at least slow down before proceeding through, which Ta did not do. Even her passenger testified that he saw the pedestrians after “bending down” to adjust the air vents. Ta should have seen the pedestrians on the side of the road before they were even crossing and stopped (like the other vehicle did).
The Crown argued this point and said Ta should have seen the pair at the side of the road before they entered the crosswalk. However, the law states that you must yield to pedestrians who are in a crosswalk. The technicality that I mentioned earlier is that a crosswalk is the area between the two big white lines on the road. You see, when Jenna Chang and her mother were standing on the side of the road drivers like Angela Ta are not required to yield to them because they are not in the crosswalk.
That explains the not guilty verdict for failing to yield to a pedestrian in a crosswalk and passing a vehicle stopped for a pedestrian in a crosswalk. The last charge of careless driving was easily beat because independent witnesses testified that Ta was driving under the 60 km/h speed limit on a straight road with both hands on the wheel (uhh… yeah, right).
Ta now still has to go through a civil trial where she will likely be found at fault. Judge Catherine Skene wrote in her decision:
“Civil liability and negligence law and a civil trial judge or jury may consider the Crown’s submissions more persuasive and impose or imply a duty of care on an operator of a vehicle for the safety of pedestrians, depending on the circumstances of the case and the facts proven during the trial”
In other words, there will not be any technicalities to get you off in civil court!

it wouldn’t surprise me if this stereotypical bad driver is at fault, but it wouldn’t surprise me if the pedestrians were at fault aswell.
I’ve had some close calls when a pedestrian steps past the curb rather then stopping for their red light. perhaps some of these pedestrians and cyclists would take some responsibility for themselves and look both ways before crossing the road, shit they teach this in grade 2.
it would be easy to blame the person doing the killing but none of us were there and none of this saw any of the evidence so none of us have the right to judge this person.
I would say both parties are at fault here, but with the death of her 6 year old daughter, and her injuries she is still recovering from I think they’ve been punished more than enough. What punishment does Angela Ta get? The courts ruled she did “nothing wrong”. I think that sends out a pretty poor message.
SOME sort of punishment should of been handed down. Come on…
in North America, where people win suits cause they burn themselves with hot coffee from McDonald’s, I am not surprised Ta was acquitted based on technicalities.
Law states, if you are on the crosswalk, drivers should stop. They weren’t when the car is approaching fast and couldn’t stop.

hmm well now that they FINALLY installed a light to cross maybe it’ll prevent any accidents from ever happening again. With such a busy intersection you’d figure they would have had a light for the crosswalk, but did they? Obviously not.
And was it the completely the drivers fault? No it wasn’t, there’s blame on the mother as well if you people have been following the stories, it says she LOOKED on the road for 20 secs before crossing with her child. Let me ask you this, if you look for a good long 20 seconds should you not see a car approaching and wasn’t completely slowed down? Instead the mother chooses to step out onto the street with a moving vehicle endangering HER life and her CHILD, but it’s a lil too late now and it’s bad what happened to the girl.

I hit a patch of ice going under 30kph while attempting to brake. It’s a busy road, and should have been kept clear. Anyways, long story short, I slid into a parked car and got a ticket. All witnesses say that I was doing well under the speed limit, and in court, even the cop who gave me the ticket said that it was absolutely an accident, and that there was nothing I could do. I was still found guilty, with no hard evidence. Whatever, it wasn’t for me to make the ruling, however, it sickens me to see this shyte on the news.

There were no other cars stopped at the crosswalk. (That’s obviously why the driver could not be convicted of that). Since when are cars expected to slow down at EVERYONE crosswalk? If you don’t see pedestrians waiting at the side of the road, you drive through. That’s what everyone does. I think that if the mother was looking for 20 seconds, she would have seen the car

What it comes down to is that both parties should have been more careful. I for one, who used to work downtown see countless number of people who walk before the light turns green. You can’t judge how fast a car is really going when you’re standing there and making that decision to risk your life by shedding a couple seconds off your time to wait. People who are so quick to judge don’t realize that everyone involved has a part in the faults that happened — regardless if anyone died or not.
Everyone who watches the news or reads the newspaper knows that the media exploits events. If they didn’t do that you wouldn’t have anything to talk about. Honestly, unless anyone personally talks to the people involved I am sure you will never get the true story.
It is sad that a child died and the mother is seriously injured, I’ll give you that and regardless of whether the driver could’ve stopped in time or not doesn’t really matter anymore. All that really matters though, is that the next time you decide to step off the curb be sure that every car in the lanes you are about to cross have come to a complete stop. I see a number of children who use crosswalks that wait for all 4 lanes to stop moving before they even thought about setting foot on the pavement. That’s good, logical and safe thinking and I think everyone needs to know that.
Besides, living with the fact that a child has died is more than unbearable — it’s something you have to deal with for the rest of your life. I think that in itself is punishment enough no matter how the driver chooses to deal with it. Don’t be so quick to judge cause maybe one day you might fall in the same situation.

i think you misunderstood my gripe with what’s happened. read it again. they let her OFF COMPLETELY on the loophole that they werent IN the crosswalk!? you have to be on the road in between the stupid white lines before a car has to slow down for you….yea, no. i’ve had many instances dealing with stupid pedestrians and un attentive drivers while attempting to cross, i dont know the full extent of the information in this case, but to hear THAT was the loophole the shiteating lawyer used to get their client off the hook, BULLSHIT.

maybe the media is wrong but the testimony in court said even the bloody passenger saw them on the side of the road before the driver. and at the last minute tried to tell her to stop. sounds like shitty driving to me, but again i dont know all the facts i just get the media’s interpretation…still sounds like shitty driving to me.
This is why I’m an advocate for cameras in public places. Public means no sense of privacy, thus no privacy issues there. Make them fixed on the intersections. That would prove for better or worse what happened here, rather than all this speculation, and hate on. Good luck with the loophole if they had video evidence, and if the passenger says he saw the pedestrian’s, that should have sealed her fate right there. Hook, Line, and Sinker.

Well I hate to break the news to you bud, THERE WAS SOMEONE crossing at the crosswalk. If Angela was going below the speed limit of 60 km/h and based on the fact she hit the two crossing the street (read: on the road) then she should have seen them on the side of the road before she reached the intersection. If there was no one at the crosswalk, of course I wouldn’t expect drivers to slow down!
Whatever happened to the advice our mother’s gave us “Look both ways before crossing the road”.
Something to consider: Look at all the parents pushing strollers. EVERYWHERE they go, the kid goes first. Could you imagine not seeing a car coming in time? Oh sure, the parent pushing the kid is fine, while the kid in the stroller gets plastered into the grill of an oncoming vehicle! I see parents pushing their kids into traffic ALL THE TIME! I watch as these infants are just inches away from the curb and the danger of traffic while mommy or daddy are safely 3 feet away!
Parents just don’t have a clue sometimes. I wonder what the particulars were in this case. It was already witnessed that there was some odd thing about 20 seconds … Anyway, last time I checked even if you the pedestrian think you are in the right, the body of a vehicle will always be tougher than the body of a human. Too many pedestrians just walk out with little attention like the whole world is going to stop for them. You must give drivers time to stop and you should check to be sure they do. You’ll never win the battle with a car even if you are right.

A: When it crossed the road at an intersection or crosswalk, it don’t cross until it made eye contact with each driver and everyone had stopped.

I know Jenna and her parents, and I think that their all pretty nice. i don’t know about Angela though, based on what I’ve heard, she had pleaded guilty to three3 charges, f***ed people on the internet, and hired a expensive lawyer for her own sake. If she had both hands on the wheel, why didn’t she stop? Where she get her drivers licence? The DUMP?
